A Clarion Call for Change: The MLP Imperative to Center Racial Discrimination and Structural Health Inequities.Dayna Bowen Matthew & Emily A. Benfer - 2023 - Journal of Law, Medicine and Ethics 51 (4):735-747.
Across the country, legal and health care professionals who understand that health outcomes are most influenced by social and environmental conditions have improved patient health by adopting the interdisciplinary MLP health care delivery model. However, the MLP field cannot advance population health, let alone long-term health equity, until it addresses the structural determinants of health inequity that are rooted in discrimination, segregation, and other forms of racial and ethnic subordination.

Race, Religion, and Informed Consent — Lessons from Social Science.Dayna Bowen Matthew - 2008 - Journal of Law, Medicine and Ethics 36 (1):150-173.
Patients belonging to ethnic, racial, and religious minorities have been all but excluded from the legal academy’s ongoing conversation about informed consent. Perhaps this is just as well, since the conversation appears to have concluded that the doctrine has failed to serve as a meaningful regulation of clinical relationships. Informed consent does not operate in practice the way it was intended in theory. More than a decade ago, Peter Schuck noted the “informed consent gap” that distinguishes the “proper” law of (...)

Together and Apart: Exploring Structure of the Corporate–NPO Relationship.Dayna Simpson, Kathryn Lefroy & Yelena Tsarenko - 2011 - Journal of Business Ethics 101 (2):297-311.
Financially significant relationships between corporations and non-profit organizations have increased in recent years. NPOs offer access to interests and ideologies that are lacking within most for-profit organizations. These partnerships form a unique bridge between for-profit and non-profit goals and offer significant potential to produce innovative ways of “doing business by doing good.” Exploration of the structural implications of these relationships, however, has been limited. The potential for ideological imbalance in these relationships, particularly for the NPO, has been poorly described. We (...)

Next Steps in Health Reform: Hospitals, Medicaid Expansion, and Racial Equity.Dayna Bowen Matthew - 2018 - Journal of Law, Medicine and Ethics 46 (4):906-912.
The confluence of racial unrest and Medicaid expansion in Virginia should inspire a national reimagining of how health care can contribute to health equity. Hospitals in particular can leverage their role as economic drivers in communities to equalize health and social outcomes for all. The urgent need for innovative opioid intervention presents a fertile proving ground for new ways that hospitals can act to reduce the impact of racial inequity. Inspired by the role hospitals played to achieve desegregation during the (...)

  13. Kinds of Social Construction.Esa Díaz-León - 2018 - In Pieranna Garavaso (ed.), The Bloomsbury Companion to Analytic Feminism. London: Bloomsbury Academic. pp. 103-122.
An important question in the debate regarding the nature of politically significant human kinds, such as gender, race, and sexual orientations, is concerned with the question of whether these human kinds are socially constructed (Stein 1999; Root 2000; Haslanger 2012; and Ásta 2013). In order to settle this debate, a more fundamental question needs to be answered: what does it mean to say that a category is socially constructed? -/- Recently, many philosophers have become interested in this issue (Hacking 1999; (...)

Access to justice and institutional regendering: The case of the National Prosecution Bureau of Chile.Bárbara Barraza Uribe & María Isabel Salinas - 2021 - Feminist Legal Studies 29 (1):1-21.
In 2017, the National Prosecution Bureau of Chile created the Special Unit for Human Rights, Gender-Based Violence, and Sex Crimes, becoming a milestone for criminal prosecution policies as the first time a state institution in Chile used the term ‘gender-based violence’ explicitly in its title. There was no law in the country that addressed and sanctioned this behaviour—recognising it as a social phenomenon—at the time of the Unit's creation. What does the creation of this new Unit mean for access to (...)

In this paper, I focus on an influential account of phenomenal concepts, the recognitional account, and defend it from some recent challenges. According to this account, phenomenal concepts are recognitional concepts that we use when we recognize experiences as “another one of those.” Michael Tye has argued that this account is viciously circular because the relevant recognitional abilities involve descriptions of the form “another experience of the same type,” which is also a phenomenal concept. Tye argues that we avoid the (...)

    Beyond compassion fatigue, compassion as a virtue.John Camilo Garcia-Uribe & Boris Julian Pinto-Bustamante - 2024 - Nursing Ethics 31 (1):114-123.
One of the great problems of caregivers and health professionals in recent times has been the so-called compassion fatigue and its association with burnout syndrome. Another pole of compassion has been described in terms of compassion satisfaction. Both propositions could be problematic in the caregiving setting. This is an analytical reflective article that through an apparent aporia tries to problematize and propose a theoretical synthesis that allows to denote compassion as a virtue in Aristotelian terms. To this end, it resorts (...)

A widespread need to explain the behavior and outcomes of AI-based systems has emerged, due to their ubiquitous presence. Thus, providing renewed momentum to the relatively new research area of eXplainable AI (XAI). Nowadays, the importance of XAI lies in the fact that the increasing control transference to this kind of system for decision making -or, at least, its use for assisting executive stakeholders- already affects many sensitive realms (as in Politics, Social Sciences, or Law). The decision-making power handover to (...)

In this chapter, I review extant empirical work concerning these and related questions in the philosophy of emotion. This will include both (1) studies investigating people’s emotional experiences and (2) studies investigating people’s use of emotion concepts in hypothetical cases. Overall, this review will show the potential of using empirical research methods to inform philosophical questions regarding emotion.

Are feelings an essential part or aspect of emotion? Cases of unconscious emotion suggest that this is not the case. However, it has been claimed that unconscious emotions are better understood as either (a) emotions that are phenomenally conscious but not reflectively conscious, or (b) dispositions to have emotions rather than emotions proper. Here, I argue that these ways of accounting for unconscious emotions are inadequate, and propose a view of emotions as non-phenomenal attitudes that regard their contents as relevant (...)

“Gender-benders”: Sex and Law in the Constitution of Polluted Bodies. [REVIEW]Dayna Nadine Scott - 2009 - Feminist Legal Studies 17 (3):241-265.
This paper explores how law might conceive of the injury or harm of endocrine disruption as it applies to an aboriginal community experiencing chronic chemical pollution. The effect of the pollution in this case is not only gendered, but gendering: it seems to be causing the ‘production’ of two girl babies for every boy born on the reserve. This presents an opening to interrogate how law is implicated in the constitution of not just gender but sex. The analysis takes an (...)

A recent quarrel over faultless disagreements assumes that disputes over evaluative sentences should be understood as regular, factual disagreements. Instead, I propose that evaluative disagreements should be understood in Lewisian terms. Language use works like a rule-governed game. In it, the assertion of an evaluative sentence is an attempt to establish one value as default in the conversation; its rejection, in turn, is in most cases the refusal to accept this move.

Voluntary management standards for social and environmental performance ideally help to define and improve firms’ related capabilities. These standards, however, have largely failed to improve such performance as intended. Over-emphasis on institutional factors leading to adoption of these standards has neglected the role of firms’ existing capabilities. External pressures can drive firms to adopt standards more than their technical capacity to employ them. This can lead to problems of “fit” between institutional requirements and a firm’s existing capabilities . We describe (...)

La eternidad del mundo y la separación del itnelecto vuelven a aparecer como sustento de una filosofía capaz de poner en tela de juicio ideas fundamentales de la modernidad como la de sujeto o persona, sin por ello entramparse en el nihilismo.

In addition, Hom supplements the semantic account with a pragmatic strategy to deal with the derogatory content of occurrences of pejorative terms in negations, conditionals, attitude reports, and so on, according to which those occurrences give rise to conversational implicatures to the effect that (...)
